These Terms of Use (“Terms”) are a binding agreement between you and SK EDUCATION TECHNOLOGY LLC (“SK Education,” “we,” “us”) governing your use of the SK Education mobile application and the SK Education web platform at platform.skedtec.com (together, the “Service”). These Terms also serve as the end user license agreement for the app.
Please read Section 14 (Disclaimers), Section 15 (Limitation of Liability), and Section 18 (Dispute Resolution) carefully — they limit our liability and affect how disputes are resolved. Section 19 contains additional terms required by Apple.

1. Acceptance of these Terms
By downloading, installing, accessing, or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
If you use the Service on behalf of a student, a family, or an organization, you represent that you have authority to accept these Terms on their behalf.
We may update these Terms. We will post the revised version here with a new “Last updated” date, and for material changes we will give notice in the app or by email at least 14 days before they take effect. Continuing to use the Service after that date means you accept the revised Terms.
2. What the Service is
The Service is a management platform for SK Education tutoring centers. Depending on your role, it allows you to view and manage schedules, request or approve session cancellations, record and review session logs and homework, track tutoring hour balances, manage student and tutor records, handle enrollment inquiries and contracts, and receive notifications.
The Service is a tool for administering tutoring services — it is not the tutoring service itself. Tutoring instruction, fees, refund terms, attendance policies, and the relationship between SK Education and an enrolled family are governed by the separate enrollment agreement signed with your center. If anything in these Terms conflicts with a signed enrollment agreement regarding tutoring services, the enrollment agreement controls for those services.
The Service is provided to SK Education’s enrolled families, tutors, and staff. Accounts are issued by SK Education as part of enrollment or engagement, rather than through public registration.
3. Eligibility, minors, and parental consent
You may use the Service only if SK Education has issued you an account, or if you are a parent or guardian using a family account. Anyone under 18 may use the Service only with the consent and supervision of a parent or legal guardian.
If you are a parent or guardian, you agree that: you consent to your child’s use of the Service; you accept these Terms on your child’s behalf; you are responsible for your child’s activity in the Service; and you consent to our collection and use of your child’s information as described in the Privacy Policy.
4. Accounts and credentials
Accounts are created and administered by SK Education. There is no public sign-up. You agree to:
- Provide accurate information and keep it current;
- Keep your password confidential and not share your account with anyone else;
- Use only your own account, and not access the Service through another person’s credentials;
- Notify us immediately at support@skedtec.com if you suspect unauthorized use of your account.
You are responsible for all activity that occurs under your account. We may deactivate an account when a student’s enrollment ends, when a staff member or tutor’s engagement ends, or as described in Section 17.
5. License to use the app
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the app on Apple-branded devices that you own or control, and to access the web platform, solely for the purposes described in Section 2. All other rights are reserved.
You may not, and may not permit anyone else to: copy, modify, translate, or create derivative works of the Service; reverse engineer, decompile, or disassemble any part of it, except to the extent this restriction is prohibited by law; rent, lease, lend, sell, sublicense, or distribute it; remove or obscure any proprietary notice; use any robot, scraper, or automated means to access it; circumvent any access control, rate limit, or security measure; or use it to build a competing product.
6. Acceptable use
You agree not to:
- Access, or attempt to access, records that your role does not authorize you to see;
- Extract, copy, or export student, family, tutor, or staff information for any purpose other than performing your role at SK Education;
- Upload content that is unlawful, defamatory, harassing, abusive, discriminatory, obscene, or harmful to a minor;
- Upload malicious code or attempt to disrupt, overload, or impair the Service;
- Probe, scan, or test the vulnerability of the Service or its infrastructure without our prior written authorization;
- Impersonate any person, or misrepresent your role or affiliation;
- Falsify records, including attendance, session logs, homework verification, hours, or payments;
- Use the Service to send unsolicited commercial messages;
- Use the Service in violation of any applicable law, including student-privacy, child-protection, employment, and export-control laws.
7. Confidentiality of student information
If you are a tutor or a staff member, you will encounter personal information about students and families, including minors. You agree to treat that information as confidential; to access it only when necessary to perform your role; not to disclose it to anyone outside SK Education without authorization; not to photograph, screenshot, or copy it to personal devices or accounts except as SK Education permits; and to return or delete any copies when your engagement ends. These obligations survive termination of your account and of these Terms.
8. Content you submit
You may submit content to the Service — session logs, notes, homework descriptions, comments, conference attachments, availability, and profile photos (“Your Content”). You retain ownership of Your Content. You grant SK Education a worldwide, royalty-free, non-exclusive license to host, store, reproduce, display, and use Your Content solely to operate and provide the Service and to maintain educational records.
You represent that you have the rights necessary to submit Your Content and that it does not infringe anyone’s rights or violate any law. Content created by tutors and staff in the course of their engagement — including session logs, progress notes, and diagnostic results — forms part of the student’s educational record maintained by SK Education.
We may remove content that violates these Terms, but we are not obligated to monitor or review content.
9. Scheduling, cancellations, and hour packages
The Service reflects your center’s scheduling and cancellation policies. In general:
- Session bookings, tutor assignments, and schedule changes are subject to availability and to approval by center staff.
- Cancellation requests submitted with at least the notice required by your center’s policy may be approved automatically; requests with less notice require staff review and may result in the session hours being deducted.
- Tutoring hours are sold in packages and tracked as a balance. Hours are deducted as sessions are completed. Expiration, transfer, refund, and family-sharing terms for hour packages are set out in your enrollment agreement.
- Information shown in the Service — schedules, balances, and logs — may be corrected by staff if an error is found. Your center’s official records control in the event of a discrepancy.
We are not liable for missed sessions, scheduling conflicts, or forfeited hours resulting from inaccurate information you provide, from your failure to check the Service, or from a device or notification setting that prevented you from receiving a reminder.
10. Fees, payments, and contracts
Tutoring fees, package prices, billing schedules, late fees, and refund eligibility are set out in your enrollment agreement with SK Education, not in these Terms. Use of the app itself is free to authorized users.
Where staff process or record payments through the Service, payments may be handled by Stripe. Where staff send enrollment contracts for electronic signature, they may use DocuSign. Your use of those third-party services, when applicable, is subject to their own terms. We do not collect or store full payment card numbers.
Purchases related to the Service are for real-world tutoring services delivered by human instructors, not for digital content or in-app functionality, and are therefore not processed through Apple’s in-app purchase system. Apple is not a party to any tutoring services agreement, is not responsible for tutoring services or fees, and does not process refunds for them. Refund requests must be directed to SK Education under your enrollment agreement.
By signing a contract electronically through the Service, you agree that your electronic signature is legally binding and has the same effect as a handwritten signature.
11. Communications and notifications
By using the Service you agree to receive operational communications from us — session reminders, schedule and cancellation notices, homework notices, contract and payment notices, account and security notices, and center announcements — by push notification, email, and in-app message. These are service communications, not marketing, and some cannot be turned off while your account is active. You can disable push notifications at any time in your device settings, and you can opt out of any marketing email using the unsubscribe link.
12. Intellectual property
The Service, including its software, design, interfaces, text, graphics, logos, and the SK Education name and marks, is owned by SK Education or its licensors and is protected by copyright, trademark, and other laws. Except for the limited license in Section 5, these Terms grant you no rights in the Service. Feedback you send us about the Service may be used by us without restriction or obligation to you.
13. Third-party services
The Service integrates with third-party providers, including Supabase, Vercel, Apple, Stripe, DocuSign, Google, and Zoom. We are not responsible for the availability, accuracy, or practices of third-party services, and your use of them is governed by their own terms and privacy policies. Links to third-party sites are provided for convenience and are not endorsements.
14. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, SK EDUCATION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that data displayed will always be accurate or current. We do not guarantee any particular academic outcome, test score, grade, or admission result. The Service is not a substitute for professional educational, psychological, or medical advice.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SK EDUCATION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR EDUCATIONAL OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SK EDUCATION FOR TUTORING SERVICES IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
16. Indemnification
You agree to indemnify and hold harmless SK Education and its officers, directors, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising from your violation of these Terms or applicable law, your misuse of the Service, your unauthorized disclosure of student or family information, or content you submit.
17. Suspension and termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms, if your enrollment or engagement with SK Education ends, if we suspect fraudulent or unlawful activity, or if we discontinue the Service. You may stop using the Service at any time and may request account deletion as described in the Privacy Policy.
On termination, your license under Section 5 ends immediately and you must delete the app. Sections 7, 8, 12, and 14 through 20 survive termination. SK Education will retain educational and financial records as described in the Privacy Policy and as required by law.
18. Governing law and dispute resolution
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, and excluding the United Nations Convention on Contracts for the International Sale of Goods.
Informal resolution first. Before starting any formal proceeding, you agree to contact us at legal@skedtec.com and give us 30 days to resolve the dispute informally.
Venue. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in San Mateo County, California, and you and SK Education consent to personal jurisdiction and venue there.
If mandatory consumer-protection rights or a mandatory forum apply where you live, nothing in this section deprives you of those rights.
19. Additional terms for Apple App Store users
These terms apply if you obtained the app from the Apple App Store. They are required by Apple, and to the extent they conflict with the rest of these Terms, they control with respect to the app.
- Agreement between you and us. These Terms are between you and SK Education only, not with Apple. SK Education, not Apple, is solely responsible for the app and its content.
- Scope of license. The license granted in Section 5 is limited to a non-transferable license to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms of Service, except that the app may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
- Maintenance and support. SK Education is solely responsible for providing maintenance and support for the app. Apple has no obligation to furnish any maintenance or support services.
- Warranty. To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are SK Education’s sole responsibility.
- Product claims. SK Education, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
- Intellectual property claims. If a third party claims that the app or your possession and use of it infringes that third party’s intellectual property rights, SK Education, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
- Contact. Questions, complaints, or claims about the app should be directed to SK Education at support@skedtec.com.
20. General terms
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and SK Education regarding the Service, and supersede prior understandings about the Service. They do not supersede a signed enrollment agreement regarding tutoring services.
- Severability. If any provision is held unenforceable, the rest remains in effect and the unenforceable provision will be modified to the minimum extent necessary.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control.
- Language. These Terms are drafted in English. Any translation is provided for convenience; the English version controls unless applicable law requires otherwise.
